On September 23, 2013, David Skaggs argued an important
case -- Kerr et al. v. Hickenlooper -- at the U. S. Court of Appeals for the
10th Circuit. Steve Oleskey flew out
to attend the session.
As David summarized in his email to Jan:
the central substantive issue in the case is: Are there certain core
responsibilities of state legislatures that may not constitutionally be
claimed by “the people” for exercise by plebiscite? For
