  • David Skaggs argues important case at the U. S. Court of Appeals for the 10th Circuit.

    On September 23, 2013, David Skaggs argued an important case -- Kerr et al. v. Hickenlooper -- at the U. S. Court of Appeals for the 10th Circuit. Steve Oleskey flew out to attend the session.
    As David summarized in his email to Jan: the central substantive issue in the case is: Are there certain core responsibilities of state legislatures that may not constitutionally be claimed by “the people” for exercise by plebiscite? For those of you who are interested in the background of the suit and the issues involved, David suggested going to an extremely good website: http://taborcase.org.
